Miscellaneous other changes to charity law

The Charities Act 2022 provides for a number of other changes to charity law, including the following.

• It confers enhanced powers on the Charity Commission to require a charity to change, or stop using, an unsuitable formal name and/or working name that it uses.

• It confers powers on the Commission to resolve uncertainties or defects in the appointment or election of charity trustees.

• It provides for gifts to a charity which has merged with another charity to take effect as a gift to the new charity.

Note that although the Act received Royal Assent on 24 February 2022, its provisions will not be effective until implemented by means of regulations to be made by the Secretary of State. Once the implementation dates for the relevant provisions of the Act are known, and if any supporting legislation is subsequently passed which impacts on those provisions, this page will be updated if and as necessary to reflect that impact.
